DESCRIPTIONS

Items are described to the best of our knowledge and ability. However, descriptions are not intended to be definitive  and should be thought of as opinions on the genuineness, authorship,  attribution, provenance, period, culture, source, origin, or condition  of the property. No statement made in item leads, descriptions, estimate  or during the sale should be considered an assumption of liability or  warranty. Lots of items that we deem to be questionable in nature will  be described as “unauthenticated”. Usage of this term does not imply  anything other than our opinion. Artworks described as a work by a  specific artist fall into our highest tier of authenticity, however, no  qualified statement about the authorship is strictly implied. Artworks  described as “attributed to...” are most likely, in our opinion, a work  by the artist but there is less certainty expressed than in the  terminology described above. Artworks whose authorship are described as  “follower of...” an artist are thought to be in the artist’s style and  contemporary or nearly contemporary to the artist. Artworks described to  have been done “in the manner of...” describes works done in the style  of the artist but at a date that is not contemporary to the artist in  question. Works described being “after” a specific artist imply that the  items are copies of known or unknown works by the artist in question.  The term signed by and/or dated by the artist is believed to have been  inscribed by the artist’s hand. The term bears signature implies that  the signature may have been added by someone other than the artist. Gems  and Coins are tested at the gallery for authenticity and are guaranteed  to be authentic. Wine is not  guaranteed to be drinkable and cannot be returned. Autographs and  autographed items are believed to be authentic unless otherwise stated.  Lots containing more than one item are intended as “dealer’s lots” and  are sold as is, where is, and the ultimate determination is the  responsibility of the bidder.

CONDITION, MEASUREMENTS, AND ESTIMATES

    Assessments  of the condition, measurements and estimates are given as a courtesy to  a client, and is only an opinion and should not be treated as a  statement of fact. We assume no responsibility for any error or  omission. The absence of a condition statement does not imply that the  lot is in perfect condition or completely free from wear and tear,  imperfections or the effects of aging. Bidders are encouraged to view  the item in person or request additional photos or measurements prior to  bidding. All graded and/or measured and mounted gemstones are examined  in mounts. Due to this, slight variations in the grading and weighing or  sizing of the stones may occur due to mounted gemstone's limited  examinability. We do not offer any type of warranty of any watch, clock,  and/or timepiece. Working conditions given for such items are stated at  the time of description. The estimated values are shown after each lot,  are the auctioneer's estimate of what each lot is likely to realize.


BIDDING

Bidding  advances shall be regulated by the auctioneer and shall be at his  discretion. He or she has the right to refuse any bids. Some of the  items offered at auction are subject to a reserve. A reserve is a  minimum price agreed upon by the consignor of the property and the  auction house. The auctioneer may bid on behalf of the consignor in  order to reach the minimum sale amount. If the minimum amount is not  reached, the auctioneer may pass the item. The auctioneer reserves the  right to bid on behalf of clients and vendors, but shall not be liable  for errors or omissions in executing instructions to bid. All bidders  are required to complete the registration and obtain a bidder number.  All registration cards contain the full name, address, phone number, and  e-mail address. Absentee bids may be left via our website, or at our  store location. Absentee bidders agree to all terms and conditions. In  terms of a tie in bidding between an absentee bidder and the house, the  house will win said item at their amount bid. The highest bidder  acknowledged by the auctioneer shall be the purchaser. In the case of a  disputed bid, the auctioneer shall have sole discretion in determining  the purchaser and may also, at his or her election, withdraw the lot or  offer the lot for resale. The auctioneer shall have sole discretion to  refuse any bid, or refuse to acknowledge any bidder. Buyers premium is  applied to all items sold at auction. This amount varies according to  the method of payment, bidding platform, or buyer’s location. Sales tax  will be applied according to federal, state, and local regulations.  Alcohol buyers must be able to prove that they are over the age of 21.


PAYMENT

All Florida residents are subject to a 7.5% sales tax. Payment  for all auction items must be received within TWO WEEKS (14 days) from  the date of auction ending. If an invoice remains unpaid for longer than  this time, the item(s) will be considered forfeited and ownership of  property will revert back to Affiliated Auctions. When bidding through  Proxibid.com, the stored payment method will be automatically processed  at the end of the auction. Payment may be made by money order or check  that is supported by a valid banker's card (up to card maximum). We also  accept MasterCard, Visa, American Express, Discover, Paypal, and  personal checks. We reserve the right to verify funds on all personal  checks. A $30 fee will apply to all returned checks. The full purchase  price on all lots sold to the same buyer must be paid before removal of  any of the items. Buyer’s Premium of 17.5% card, 12.5% cash/check  applies to bidders on the floor, phone, and absentee. If you bid through  one of the websites, Buyer’s Premium applies as follows: PROXIBID:  19.5%, LIVE AUCTIONEERS: 18% AFFILIATED'S OWN BIDDING PLATFORM: 17.5%  card / 12.5% cash or check, and INVALUABLE/ AUCTIONZIP: 25%. We will not accept payment through PayPal  if you have purchased any of these items: controlled substances or  other products that present a risk to consumer safety, drug  paraphernalia, items that encourage, promote, facilitate or instruct  others to engage in illegal activity, items that promote hate, violence,  racial intolerance (including Nazi, Ku Klux Klan, IRA, Cuban or  Communist items), or the financial exploitation of a crime, items that  are considered obscene, items that infringe or violate any copyright,  trademark, ammunition, firearms, items of or certain firearm parts or  accessories, or certain weapons or knives regulated under applicable  law. RETURNS

Items described as being sold "as-is" are being sold in their current state without any guarantee and cannot be 

returned.  If a guaranteed item is deemed not to be authentic by a panel of three  competent authorities, a full refund of the purchase price and buyer's  premium shall be the limit of liability of the auction company and or  its 

representatives. Returns must be authorized and made within 10 days.

Please  allow up to 2 weeks after payment for shipping to occur. Affiliated  Auctions and Realty, LLC. does not guarantee to ship any item. As a  courtesy to the buyer, we can arrange for a third-party shipper to  receive your items and ship them at the buyer's expense. If the buyer  does not want to use our provided third-party shipping, it is the  buyer's responsibility to notify Affiliated Auctions before payment of  the item. In order to obtain shipping estimates from third-party  shippers, please contact the Tallahassee UPS Store (#2281) at (850)  224-9969. To avoid shipping charges, any winning bidder, on-site or  online, has the option of picking up their items at the Affiliated  Auctions Gallery located at 2500 Apalachee Parkway, Tallahassee, FL  32301. If the buyer chooses to pick-up auction items, they should notify  Affiliated Auctions before making payment. PLEASE NOTE: WITH THE EXCEPTION OF WINE,  WE DO NOT SHIP ANY OTHER ALCOHOL, NOR DO WE ARRANGE SHIPPING FOR  ALCOHOL. Affiliated Auctions will ship firearms which require a Federal  Firearms License (FFL) or Curio & Relics (C&R) License to the  dealer provided by the buyer. The cost of shipment will include  shipping, handling, insurance, and any other necessary service. Please  contact Affiliated Auctions prior to bidding for estimates. Ivory items  will only be shipped within the United States, except to California,  Hawaii or Alaska. When purchasing firearms, it is the buyer's  responsibility to provide Affiliated Auctions & Realty with a  current Federal Firearms License (FFL) or Curios & Relics License  (C&R). We will NOT ship firearms unless we have a current FFL and/or  C&R license. All firearms will be shipped to the license holder's  Premises Address. The license may either be faxed to (850) 656-8948 or  e-mailed in an attachment to Firearms@affiliatedauctions.com.  All items shipped by Affiliated Auctions will be shipped within 10  business days after receipt of payment. We will schedule a pick-up of  all items to be shipped by third-party shippers within 10 business days  after receipt of payment; after which time Affiliated Auctions will  consider the item shipped. Shipping charges are the responsibility of  the bidder. In the event an item is shipped by Affiliated Auctions, the  shipping carrier will vary depending on the items purchased. Either UPS  or USPS will be used. If multiple items purchased require more than one  box, packing and handling will be charged on a per box basis. If paying  by check or money order, please contact the auction house for payment  instructions on shipping. All shipping and packing arrangements for  over-sized items are the responsibility of the buyer. All buyers are  strongly encouraged to get quotes from shipping companies and make  arrangements prior to bidding. To help expedite our shipping process, we  will be adding the cost of shipping and handling to items that we ship  in-house. This will ensure that your winnings are sent out as soon as  possible. This excludes items that are large or fragile as they will be  shipped via a third-party shipper.

STORAGE FEES

After  the item has been paid for, the buyer has 30 days to arrange for  shipping. Affiliated Auctions will no longer be responsible for the item  during this time. If the item remains in the gallery after this period,  the item will be considered abandoned and ownership will revert back to  the auction house.
